Denmark - New Regulations For Posted Workers

The Danish Parliament adopted in November 2024 a series of strict requirements for the posting of foreign workers in Denmark. The new rules aim, among other things, to prevent the use of illegal labour and to ensure that foreigners do not work for lower wages and under unacceptable conditions.
 
The new rules require foreign service providers/employers who wish to post third-country nationals to Denmark to upload a copy of the service agreement, employment contracts, any posting agreements, and work permits for the individuals concerned to the Register of Foreign Service Providers (RUT from its Danish acronym). These requirements apply in addition to the information foreign employers are already required to report to RUT. The rules will enter into effect on 1 January 2026.
 
Additionally, the service provider/employer must ensure that both Danish and foreign employees can present valid identification to the Danish Working Environment Authority and the Danish Agency for International Recruitment and Integration (SIRI) during inspection visits. The rules entered into effect on 1 January 2025.
 
The Danish Parliament has also passed a law setting requirements for the housing provided by employers to their employees in Denmark. Employers must ensure that the housing provided to one or more employees in Denmark meets the existing standards for housing in Denmark.

The requirements include, among other things, protection against moisture, cold, and heat; access to daylight; satisfactory indoor climate; access to a toilet and drinking water; and limits on the number of people accommodated in the same housing. The rules are scheduled to enter into effect on 1 July 2025, and the Danish Working Environment Authority will oversee employers' compliance with these regulations.
